He was killed by John Elliot in 1816. Russel Co. Va Court shows Elliot was held over for trail Nov. 6, 1816. Apr-1817 Term of Russell County Virginia court, Abner Vance distinguished himself in the trial of John Elliott. John Elliott was being tried for the murder of Eli McLaughlin. Eleven of the jurors stood for first degree. Abner Vance "hung the jury" and with his eloquent oratory won them over.
Instead of hanging, the sentence was "nine years in the penitentiary house in a solitary cell with a low coarse diet for half of the term."

This indenture made this 6th day of March in the year of our Lord 1830 between Jacob King and Mary his wife, late Mary McLaughlin, who was the widow of Eli McLaughlin deceased, Joseph Kinser and Ann his wife, late Ann McLaughlin daughter of the said Eli deceased, Israel McLaughlin a son of said Eli and Elizabeth his wife, Philip Flanagin and Elizabeth his wife, late Elizabeth McLaughlin daughter of the said Eli deceased, ____?____ [unreadable] Yeary and Eliza his wife, late Eliza McLaughlin daughter of said Eli deceased, James Allen and his wife Mary, late Mary McLaughlin and Matilda McLaughlin, also children of the said Eli deceased of the first part and James Browning of the County of Russell and state of Virginia, witnesseth that the aforesaid parties of the first part for and in consideration of the sum of three hundred dollars to them in hand paid, the receipt of which is hereby acknowledged, do grant and bargain and sell unto the said James Browning and his heirs, a certain tract or parcel of land containing 97 acres be the same more or less, lying and being in the said county of Russell on Jesseeās Mill Creek, which was granted to Charles Kinzer from this Commonwealth by patent bearing date of the 17th day of Sept. 1800 and was conveyed to the said Eli McLaughlin from John Candler and Dorthy his wife, by deed recorded in the court of said county and bearing date of the 3rd day of January 1814; and which said tract is bounded as followeth, to wit: Beginning at a white oak on the south side of said creek N50 degrees W20 poles to a dogwood lying N70 degrees 18 poles crossing the creek to a white oak S50 degrees E 4 ? poles to a gum S55 degrees E100 poles to a white oak N70 degrees E20 poles to a white oak and poplar S35 degrees E18 poles to a white oak and maple S35 degrees E28 poles to a buck and maple N77 degrees W20 poles crossing the Creek to a poplar S64 degrees W40 poles to a chestnut and sugartree West 20 poles to a double chestnut S40 degrees W24 poles to a chestnut N80 degrees W40 poles to a black oak W25 degrees 20 poles to a small black oak, N85 degrees W40 poles to a dogwood N40 degrees W20 poles to a dogwood N40 poles to a white oak and N60 degrees E92 poles to the beginning. With the appurtenances to the said James Browning and his heirs, to the sole use and behoof of the said James Browning and his heirs forever. And the said parties of the first part for themselves and their heirs to covenant and agree with the said James Browing and his heirs, that they the said parties of the first part and their heirs the said tract or parcel of land with the appurtenances unto the said James Browning against the claims of the said parties of the first
part and of all known claiming by, through, or with them and their heirs. In witness whereof the said parties of the first part have hereunto subscribed their names and affixed their seals, the day and year first above written.
